Guardianships

Guardianships are court proceedings where an individual is determined to be incapacitated and in need of a guardian to manage the financial and/or personal affairs of the incapacitated person. Guardianships are typically necessary where there has been no agent appointed via a power of attorney. In the course of a guardianship proceeding, our office will provide the following services:

  • Preparing and filing with the court of all appropriate documentation, including the petition, consents and all affidavits
  • Ensuring that the appropriate medical testimony is available and presented to the court
  • Requesting special relief such as Medicaid Planning and end of life care
  • Representing the petitioner at the court hearing
  • Helping the guardian prepare the annual reports
